| I am going back and watching Season 2 some more, and I am thinking about something that happens in the trial of Dr. Sara. Kellerman comes to testify to her defense. He says that he had orders to kill her, and that was the reason that she gave support and comfort to the brothers after the escape. My question is, criminally speaking, how would this exonerate Sara? The principle of an affirmative defense (self-defense, insanity) must be stated at the start of a trial in order for it to be legally viable. I did find this online though: ----- An affirmative defense must be timely pleaded by the defendant in order for the court to consider it, or else it is considered waived by the defendant's failure to assert it. What constitutes timely assertion is often itself the subject of contentious litigation. ----- The PB writers at least do their research. I'm kind of impressed that I thought there was a hole here and there wasn't.

| ^^^ It is funny isn't it!!! How are you Candy? BTW? I have been working all night for a work inspection on thursday next... Lots of paperwork, reviewing of at least 57 work policies... it's really heavy reading... I have to sign them all of too... I am shattered now, must go to bed... Will probably be back on here tomorrow as I worked overtime tonight and did some of tomorrows jobs... was in a run or whatever... I miss Helps on here... | Can a prosecutor drop charges in the middle of a trial? I don't think I've ever seen that before......we need more lawyers on here.

| I found the answer to my own question, a prosecutor can drop charges at any point in the trial before (or during I think) their closing statment.
