Arg, his ability is not to "assume any superhuman capacity", but he has the ability to know how things work. Once he figures out how something works, he is then able to use the power.

He gotta have an ability that we don't know about cuz I don't think he dies in season1. I mean he crawled away. I hope he's gonna make it cuz I don't want any other villain, he's just PERFECT.

And, he doesn't die =] I read on Wikipedia that Sylar comes back in Season Two as a regular.

BAH. So many errors... I don't think he crawled away at the end of Season 1 of Heroes so much as was dragged away... Perhaps by the 'worse thing'. I hope that the info on Wikipedia is correct in that he returns, otherwise I don't think I'll watch the show. Zachary is indeed an excellent actor, to go from a flamboyantly gay, leaping, shouting man, to a cold, power-hungry killer. It's enough to make me go "SQUEE".
